Terms & Conditions – v.09052026

Virtue Travel, LLC, d.b.a. FanTabulous Getaways!, (collectively referred to herein as the “Agent”, "we", "us", or "our") acts strictly as the booking agent for your travel needs. The person, entity, or their representatives using our services, website, or booking a reservation through us are referred to as the “Guest”, “you”, and “your” throughout this Agreement.

By utilizing our services, website (www.fantabulousgetaways.com), or paying a deposit or invoice, you legally agree to these Terms & Conditions.

1. Duration & Scope of Agreement

This Agreement commences on the date we accept your account application form via our website or the date you place a booking through us via email, telephone, or booking link. It shall continue for the duration of time we provide travel management services to you. This Agreement is non-exclusive.

2. Agency & Supplier Liability

During the Term, we will use our best efforts to provide you with services as requested. We sell a variety of travel-related products from different third-party suppliers and service providers (the “Suppliers”).

  • Agency Relationship: We act only as an Agent for the relevant transport, accommodation, or other travel service providers. Our obligation to you is to make travel bookings on your behalf.

  • Separate Contracts: You will be entering into a separate contract with these Suppliers. Each Supplier has its own terms and conditions that apply to your arrangements, and you should ensure you understand them.

  • No Liability for Suppliers: The travel service provider, and not the Agent, will be responsible to you for the provision of the travel service. We are not a co-vendor of such products and services. Specifically, if a Supplier is unable to provide the travel services for which you contracted, your legal recourse lies against the Supplier, not against us.

 

3. Cancellations & Refunds

Guests have a right to cancel this Agreement. YOU, THE BUYER, MAY CANCEL THIS TRANSACTION AT ANY TIME PRIOR TO MIDNIGHT OF THE THIRD BUSINESS DAY AFTER THE DATE OF THIS TRANSACTION.

  • In the event Guest chooses to exercise the cancellation right, Guest agrees to pay Virtue Travel, LLC for any and all services that Guest utilized prior to cancellation at the published non-Guest rates.

  • Guest acknowledges that flights are in most instances non-refundable after 24 hours of booking. Deposits for cruises, hotels, and resorts may or may not be refundable, depending strictly on the specific Supplier’s cancellation policy.

 

4. Custom Planning & Professional Fees

Virtue Travel, LLC charges a separate, non-refundable Custom Planning Fee (also known as a Professional Design Fee) for the time, expertise, research, and personalized service required to curate your customized itinerary.

  • Separate Cost: This fee covers our professional travel management services and is completely separate from the actual cost of your travel arrangements (e.g., flights, accommodations, tours).

  • Upfront Payment: The Custom Planning Fee must be paid in full prior to the commencement of any preliminary research, quoting, or booking processes.

  • Non-Refundable: Because this fee compensates us for our initial time, consultation, and professional expertise, it is strictly non-refundable. This remains true regardless of whether you ultimately decide to book the proposed itinerary, or if your trip is later modified, postponed, or canceled for any reason by you, us, or the Suppliers.

 

5. Travel Insurance (Highly Recommended)

We strongly recommend that you purchase comprehensive travel insurance to protect your investment. Travel insurance can help cover unexpected events such as trip cancellations, interruptions, medical emergencies, lost baggage, and supplier defaults. If you choose to decline travel insurance, you assume full financial responsibility for all risks and potential losses associated with your trip.

 

6. Travel Documents, Passports & Visas

Travel documents include airline tickets, hotel vouchers, tour vouchers, or any other document used to confirm an arrangement. These may be subject to strict conditions (e.g., non-refundable, non-date-changeable, non-transferable).

  • Name Accuracy: All tickets must be issued in the exact name matching your government-issued passport/photo identity. Incorrect names may result in an inability to travel and booking cancellation.

  • Passports & Visas: You assume full responsibility for checking and verifying all passport and visa requirements for your destinations. All international travelers must have a valid passport (many countries require at least 6 months of validity past your return date and unstamped blank pages).

  • Travel Advice: U.S. Citizens should refer to the U.S. Department of State at www.travel.state.gov for travel advisories and health requirements.

 

7. Health, Safety & Vaccinations

Guest is responsible for complying with all health requirements and recommended vaccinations of the destination countries. During local or national holidays abroad, certain facilities (museums, tours, medical facilities, shopping) may be limited.

 

8. Force Majeure

Virtue Travel, LLC shall not be liable for any failure or delay in performing its obligations under this Agreement if such failure or delay is due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, pandemics, epidemics, government restrictions, strikes, or extreme weather conditions.

 

9. Use of Services and Website

You agree to use our website and services only to make legitimate reservations or purchases and shall not make speculative, false, or fraudulent reservations. You agree to use our website and services in compliance with all applicable laws.

 

10. Indemnification

You agree to indemnify and hold harmless Virtue Travel, LLC, its affiliates, Suppliers, officers, directors, employees, and agents from any claims, causes of action, demands, losses, damages, or other costs (including reasonable legal fees) brought by you or third parties as a result of (a) your breach of this Agreement, (b) your violation of any law or rights of a third party, or (c) your use of our website.

 

11. Changes & Modifications

The Agent reserves the right to change, suspend, or terminate any of its services or suppliers at any time, including changes to fees or benefits. We will advise you of such changes no less than thirty (30) days prior to implementation.

 

12. General Provisions

  • Data Protection: We maintain appropriate technical and organizational measures to protect your personal data.

  • No Joint-Venture: We are acting as an independent contractor. No joint venture, partnership, or employment relationship exists between you and us or our Suppliers.

  • Electronic Signatures: Each party agrees that electronic signatures and acknowledgments (whether digital, encrypted, via email, text message, or chat) are intended to authenticate this writing and have the same force and effect as manual signatures.
